Terms of Service

By accessing or using goBuildy ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms constitute a legally binding agreement between you and goBuildy. We may update these Terms from time to time; continued use of the Service after we notify you of changes constitutes acceptance of the updated Terms.

goBuildy is an AI-powered website generation service. You describe your business in plain language, and our system uses artificial intelligence to generate a professional website for you. The generated site is hosted on goBuildy's infrastructure and delivered to your visitors.

The websites generated by goBuildy are produced by large language models (LLMs) including Google Gemini and Anthropic Claude. By using the Service, you understand and agree to the following:

• AI content is not professional advice. Nothing in an AI-generated site constitutes legal, medical, financial, tax, or other professional advice. If your business requires such advice, consult a licensed professional.
• AI content may contain errors. LLMs can produce inaccurate, incomplete, or outdated information. You are responsible for reviewing, editing, and verifying all content on your generated site before publishing it to real customers.
• You are responsible for your site's content. By completing checkout and deploying your site, you confirm that the site's content does not violate any applicable laws or third-party rights (see Section 7, Acceptable Use).
• AI model routing. goBuildy selects the AI model used to generate your site based on availability and load. The specific model used is not guaranteed and may change without notice.

When goBuildy registers a domain on your behalf, the following terms apply:

• goBuildy is the registered domain holder. To eliminate checkout friction, goBuildy registers purchased domains using its own registrant contact information. Your personal details are never filed with the domain registry. WHOIS privacy protection is enabled by default, keeping all registrant contact information out of public lookups.
• Domain held in goBuildy's AWS account; you are the beneficial owner. goBuildy acts as custodian on your behalf. The domain exists to serve your website and you retain full control over it through your goBuildy account.
• Transfer-out is always available: free, no questions asked. Click “Get my domain transfer code” in your dashboard at any time to receive the EPP auth code. Transfers follow the standard 5–7 day ICANN process.
• Auto-renewal, covered by goBuildy. Domains are set to auto-renew annually. The renewal cost is absorbed by goBuildy as part of your USD 22/month subscription: there is no separate renewal charge to you. You will receive a courtesy email 30 days before the renewal date.
• Domain name use and indemnification. You may not register a domain name that infringes any third party's trademark, trade name, or other intellectual property rights. By selecting a domain under the Domain Purchase option, you represent and warrant that the chosen domain does not infringe any such rights. If any third party brings a claim (including a UDRP proceeding) against goBuildy in connection with a domain registered for you, you agree to: (a) indemnify and hold goBuildy and its operator harmless from any costs, losses, or adverse decision arising from such claim; and (b) cooperate fully in any such proceeding, including providing accurate information on short notice.
• On subscription cancellation. When your goBuildy subscription is cancelled, we will disable auto-renewal and notify you by email with transfer-out instructions. You have until the domain's next renewal date to transfer it to another registrar at no charge. Transfer-out is always free. The EPP auth code is shown automatically at the time of cancellation and can be requested again at any time by emailing hello@gobuildy.com.
• After the domain expires. If you do not transfer before the renewal date, the domain enters a standard expiry wind-down: approximately 30 days of suspended grace period (still transferable, though your new registrar may charge a restore fee), followed by a ~30-day redemption period, then ~5 days of pending delete before the domain becomes available to the public, roughly 65 days from expiry in total. goBuildy is not liable for loss of the domain after the expiry date if you did not act during the transfer window. We strongly recommend transferring before the renewal date, not after.

Before purchasing a plan, you receive a free, watermarked preview of your site at a temporary link. The link lasts 72 hours unless we extend it. When it closes, we keep an unpublished copy for 45 days so we can reopen it if you ask, and then it is deleted.

The free preview does not constitute a guarantee that your final published site will be identical in appearance or content; minor differences may occur during provisioning.

goBuildy may, at its discretion, require a refundable USD 1 design deposit after your first free site generation before unlocking additional regenerations or proceeding with publishing. This deposit is not currently in effect; if and when goBuildy enables it, the following terms apply:

• Authorization, not charge. The USD 1 deposit is a card authorization hold authorized through our payment processor. Your card is not charged at the time of authorization; the hold simply verifies that a valid payment method is on file.
• Credited on publish. If you purchase a goBuildy subscription within 72 hours of authorizing the deposit, the USD 1 is captured and immediately applied as a credit against your first month's subscription invoice. You are not double-charged.
• Automatic release. If you do not purchase a subscription within 72 hours of authorization, the hold is automatically voided and released in full. No charge appears on your statement. Depending on your card issuer, the pending hold may take 3–7 business days to disappear from your balance.
• No subscription commitment. Authorizing the USD 1 deposit does not create a subscription or any recurring payment obligation. It only unlocks additional AI regeneration attempts during your 72-hour free preview window.
• Non-refundable after capture. Once captured (i.e., you completed a subscription purchase), the USD 1 is applied as a credit and is non-refundable as a standalone item. The credit remains on your account and reduces your first invoice.

You agree not to use the Service to generate or host content that:

• Is illegal under applicable federal, state, or local law.
• Infringes any copyright, trademark, trade secret, patent, or other intellectual property right.
• Is defamatory, harassing, abusive, or threatening toward any individual or group.
• Constitutes spam, phishing, or any form of deceptive marketing.
• Depicts or promotes child sexual abuse material (CSAM): zero tolerance, reported to NCMEC immediately.
• Facilitates unlicensed financial services, gambling, or the sale of illegal substances.
• Impersonates another person, business, or government entity.

goBuildy reserves the right to remove any site that violates these terms without notice and without refund, and to report relevant content or activity to law enforcement.

If your plan includes it, you can invite other people to work on part of your site (for example, to manage your catalog's listings). You are responsible for what they do with that access as if you had done it, for telling them how we handle their data (see our Privacy Policy), and for removing their access when they stop working with you. For those people's data, you are the controller and goBuildy is the processor holding it on your behalf.

If your site has Bookings, you can connect your business's WhatsApp Business so booking notifications go out on their own from your number: a confirmation when the booking is confirmed and a reminder before the appointment, at the time you choose. You keep using WhatsApp Business on your phone as usual.

• Your account and your contract with Meta. When you connect your number, you accept Meta's terms for the WhatsApp Business Platform and its Messaging Policy: that contract is between you and Meta. The account and the number are yours. Meta charges the notifications to the card you add to your WhatsApp account. Meta sets and changes its prices, approves or rejects the messages, and may limit sending or suspend your account. Those decisions are Meta's, not ours.
• What the notification says. The text is the same for every business and is approved by Meta: the person's first name, your business's name, the day and time of the appointment, your address if you added it, and how to stop receiving them. Never the booking note. The name is the one you enter in "Business name in the messages": use only your business's name, without the type of visit or treatment.
• Who does what with the data. For your customers' data, you are the controller and goBuildy is the processor acting on your behalf. Meta also processes it as your processor, under your contract with Meta. You expressly authorize us to send Meta, on your behalf and with the access you gave us, what each notification contains, and to receive what WhatsApp sends us while your number is connected: the status of each notification, the messages people send to your number and what comes from your app (your contacts, the messages you send and, if you choose to share it, your chat history).
• What goBuildy does. We only send a notification to people whose profile says they want them. Of the messages people send to your number, we only check whether they say "STOP" or "BAJA": if so, we record in their profile that they don't want them and reply that they won't get any more. We discard everything else without keeping it. We use this data for nothing else: no advertising, no artificial intelligence, no other businesses. Access to your account is stored encrypted, separately from your customers' data.
• Only record a yes you were given. Your booking page asks and stores the answer. If you book someone manually, ask first and record in their profile how they told you.
• Honor opt-outs. If someone asks you to stop the notifications, including outside WhatsApp, record it in their profile.
• Children under 13. Book the appointment under the name and phone number of the adult who requests it: the notification goes to them.
• Keep your contact up to date. Your site shows a privacy notice with your business's contact, so your customers know how to reach you about their data. Keep that contact up to date in your dashboard. If your site has no contact, the notice does not appear.
• Your country's law. Comply with your country's data protection law (for example, registering your database where required) and with Meta's and WhatsApp's terms and policies.
• Liability. goBuildy is not responsible for Meta's decisions (prices, approvals, limits, suspensions, outages) or for notifications that are not sent, not delivered or delivered late. Notifications do not replace keeping your own calendar. If someone makes a claim against goBuildy because you recorded a yes you were not given or ignored an opt-out, that claim is your responsibility. Everything else is subject to the limit in Section 11, to the extent the law allows.
• Disconnecting. You can disconnect your number at any time from your dashboard. You can also ask us at hello@gobuildy.com and we do it within 5 business days. From then on no notification is sent and we delete our access to your account. Notifications already sent stay with each booking. To cut it off completely, in the WhatsApp Business app go to Settings > Account > Business platform and tap "Disconnect account". Your number keeps working on your phone.

goBuildy may suspend or terminate your account at any time if you violate these Terms, engage in fraudulent activity, or if we are required to do so by law. In the event of termination for cause, no refund is owed.

You may cancel your subscription at any time from your account dashboard. Upon cancellation, your site will remain live until the end of your paid billing period, after which it will be taken offline and your data will be deleted per our Privacy Policy retention schedule.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. GOBUILDY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL MEET YOUR EXPECTATIONS OR BE SUITABLE FOR ANY PARTICULAR PURPOSE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GOBUILDY'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO GOBUILDY IN THE 3 MONTHS PRECEDING THE CLAIM.

GOBUILDY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL.

These Terms are governed by the laws of the United States applicable to agreements made and performed entirely within the United States, without regard to conflict-of-law principles. Any disputes shall be resolved through binding arbitration under JAMS rules, with proceedings conducted in English. Class actions are waived to the fullest extent permitted by law.

goBuildy is administered by an individual. The information below is published in accordance with the requirements of the payment processors we operate with.
